Privacy Policy

How Probeam collects, uses, and protects your personal data — under the revised Swiss Federal Act on Data Protection (revFADP, in force since 1 September 2023) and, where applicable, the EU General Data Protection Regulation (GDPR).

1. Data controller

The data controller within the meaning of the Swiss Federal Act on Data Protection (FADP) is Probeam GmbH, c/o Suisse Technology Partners, Querstrasse 5, 8212 Neuhausen am Rheinfall, Switzerland. Contact: privacy@probeam.ch.

2. Scope

This privacy policy describes how Probeam collects and processes personal data through the probeam.ch website and through direct communication channels (email, telephone). It applies in addition to any project-specific data processing agreement concluded with a customer.

3. What personal data we collect

We collect (a) data you provide directly when contacting us — name, company, email address, telephone number, and any details you include in your message; (b) technical data automatically transmitted by your browser when visiting the site — IP address, user agent, referrer, page visited, timestamp; (c) cookies and similar technologies as described in section 7 below. We do not collect special categories of personal data through the website.

4. Purposes and legal basis

We process personal data to (i) respond to enquiries and provide quotations; (ii) deliver the services you have requested; (iii) operate, secure, and improve the website; (iv) comply with legal and regulatory obligations under Swiss law. Processing is based on your consent (FADP Art. 6 para. 6), the necessity to perform a contract or pre-contractual measures, our legitimate interest in operating a secure and effective website, and our legal obligations.

5. Server log files

When you visit the website our hosting provider automatically records anonymised log entries (IP address, browser type, operating system, pages requested, timestamp). These logs are used solely for security, troubleshooting, and statistical analysis, and are deleted or anonymised within a short retention period.

6. Recipients and processors

Personal data may be disclosed to carefully selected service providers acting as data processors on our behalf — including hosting, email delivery, and analytics. All processors are bound by written agreements requiring an adequate level of data protection. We do not sell personal data, and we transfer data outside Switzerland or the EU/EEA only when an adequate level of protection is ensured (e.g. EU Standard Contractual Clauses or recognised adequacy).

7. Cookies and tracking

The website uses strictly necessary cookies required for its operation. We do not use marketing or advertising cookies. If we ever introduce optional analytics cookies, they will require your prior consent through a cookie banner and you will be able to withdraw consent at any time.

8. Retention

Personal data is retained only as long as necessary for the purpose for which it was collected, or as required by Swiss law. Quotation enquiries that do not result in a contract are typically deleted within 24 months. Project-related data is retained for the duration of the project plus the legally required archiving periods (typically 10 years for accounting records under the Swiss Code of Obligations).

9. Your rights

Under the FADP, you have the right to obtain information about the personal data we process about you, to request rectification of inaccurate data, to request deletion or restriction of processing, and to object to processing. If you are located in the EU/EEA, the GDPR additionally grants you the right to data portability and the right to lodge a complaint with a supervisory authority. 10. Data security

Probeam implements appropriate technical and organisational measures to protect personal data against unauthorised access, alteration, disclosure, or destruction. Customer scan data is stored on access-controlled systems and is not made publicly accessible.

11. Supervisory authority

If you believe that the processing of your personal data violates the FADP, you may lodge a complaint with the Federal Data Protection and Information Commissioner (FDPIC), Feldeggweg 1, 3003 Bern, Switzerland — www.edoeb.admin.ch.

12. Changes to this policy

We may update this privacy policy from time to time to reflect changes in our practices or legal requirements. The current version is always published on this page.
